Why Every PSW & HCA Should Join a Professional Association 

As a PSW or HCA, you provide essential care to those in need. But how do you protect yourself and ensure professional credibility?  

Being part of a professional association is a smart career decision. 

Nurses and doctors have professional associations, so why not PSWs and HCAs?

Many Caregivers Think They’re Fully Protected—But Are They?  

One of the biggest misconceptions among PSWs and HCAs is that their employer’s insurance fully covers them. This statement is NOT always true. If you work in a hospital or other facility, you are covered by insurance while you’re on the clock, you may not be covered.  

If you have private clients or work for an agency, you must carry your own insurance. You can’t assume that you are covered or that nothing bad will happen. Here’s why.  

1. Employer Insurance Protects the Company First

Hospitals and agencies carry liability insurance, but it’s designed to protect the company first—not necessarily the individual worker. 

If a caregiver is named personally in a lawsuit, they may be required to cover their own legal fees and defence.  

If you are an HCA or a PSW, you must understand that your employer’s insurance does not follow you. If you take private clients, work freelance, or provide care outside of your primary job, you are not protected.  

Here’s an example. A PSW is accused of negligence while working for an agency. The agency’s legal team defends the company, but the worker must hire a lawyer at their own expense. As you might imagine, this could cost thousands of dollars. If the suit finds for the defendant, the PSW may also be on the hook for millions in liability.  

What If You Help Someone Outside of Work and They Get Hurt? 

Many caregivers help friends, neighbours, or family members outside of their official jobs. It’s part of their caring nature and who they are at the core. But what happens if someone falls, gets injured, or claims improper care? 

Since this did not happen under an employer’s insurance policy, the worker is personally responsible for any medical costs, legal fees, or lawsuits that ensue. 

For example, a PSW helps their elderly neighbour with a simple task, such as getting out of bed or walking to the kitchen. The neighbour falls and breaks their hip. Their family sues the caregiver for medical expenses. Since this was an informal arrangement, the caregiver has no insurance protection and must cover all costs out of pocket.  

While fear of legal action should never stop you from helping someone in need, you can protect yourself. Membership in a professional association provides PSWs with the liability coverage and legal support they need on and off the job.
