Purpose

The Safety and Conduct Policy (“Policy”) underscores Carelancer’s commitment to maintaining a professional, respectful, and secure environment for all users. This Policy outlines the responsibilities of Care Seekers and Decision-Makers to ensure the safety and professionalism of Care Providers providing Assistance Services arranged via the Carelancer platform (“Platform”).

Scope

This Policy applies to all Care Seekers and Decision-Makers who use the Platform to retain Care Providers for Assistance Services. All Care Seekers are required to adhere to this Policy to promote a safe, ethical, and professional environment for all users of the Platform.

Responsibilities of Care Seekers and Decision-Makers

1. Maintain a Safe Environment

Care Seekers and Decision-Makers are responsible for providing a safe and hazard-free environment for Care Providers who are providing Assistance Services. Without limiting the generality of the foregoing, Care Seekers and Decision-Makers must adhere to the following standards:

· Hazard-Free, Clean and Organized Spaces: Ensure that the area where Assistance Services will be provided (the Service Area) is clean, organized, and free of obstacles or hazards that could compromise safety (i.e., exposed electrical wiring on unsanitary surfaces).

· Pet Control: Secure pets separately from the Service Area to prevent distractions or risks to Care Providers, except for service dogs, which are permitted under applicable accessibility laws.

· Adequate Accessibility: Provide clear directions to the Care Seeker’s residence and ensure safe, well-lit access, including suitable parking arrangements if required.

· Emergency Preparedness: Inform Care Providers of any known safety concerns regarding the premises and provide emergency contact details if necessary.

2. Foster Respectful and Professional Interactions

Care Seekers and Decision-Makers are expected to:

· Communicate Clearly: Provide accurate and detailed information about the required Assistance Services, including timelines, expectations, and any specific needs.

· Demonstrate Courtesy: Treat Care Providers with respect, professionalism, and courtesy at all times.

· Honor Agreements: Abide by the agreed-upon terms of service (as agreed-upon on the Platform) and avoid unreasonable or last-minute changes unless mutually agreed upon.

· Respect Boundaries: Avoid intrusive or inappropriate inquiries and maintain a professional relationship with Care Providers.

3. Adhere to Ethical Standard

· Non-Discrimination: Discrimination of any kind, including without limitation based on race, gender, religion, age, disability, or other protected characteristics is strictly prohibited. Any reports of discrimination towards Care Providers by a Care Seeker, Decision-Maker or other individual present when Assistance Services are being provided will result in a permanent ban from the Platform.

· Zero Tolerance for Harassment: Harassment, intimidation, or any form of inappropriate behavior is strictly prohibited.

Prohibited Conduct

Care Seekers and Decision-Makers are strictly prohibited from engaging in the following behaviors:

· Threatening or Intimidating Behavior: Any actions, threats or language that may create a hostile, unsafe, or uncomfortable environment for Care Providers.

· Unethical or Unreasonable Requests: Soliciting tasks beyond the agreed-upon Assistance Services, engaging in illegal activities, or placing Care Providers in unsafe situations.

· Inappropriate Advances: Making unwelcome personal remarks, gestures, or other inappropriate advances toward Care Providers.

· Retaliation Against Care Providers: Any form of retaliation against a Care Provider for refusing to provide services other than the agreed-upon Assistance Services, reporting a concern, or enforcing boundaries is prohibited. Retaliatory actions, including negative reviews or refusal to engage in future services due to personal bias, are strictly prohibited and may lead to your immediate expulsion from the Platform, at Carelancer’s sole discretion.

· Providing False or Misleading Information: Care Seekers and Decision-Makers must not misrepresent service needs, health conditions, or home environments to mislead Care Providers.

Reporting and Incident Management

Raising Concerns

Care Seekers are encouraged to report unsafe or inappropriate behavior to Carelancer’s Support Team by contacting: · Email: [email protected]

Confidentiality

All reports will be handled confidentially to protect the privacy and dignity of all parties involved. Carelancer is committed to maintaining a fair and impartial process.

Resolution and Enforcement Process

Carelancer will promptly investigate all reported incidents and take appropriate action based on the severity of the violation. Following the completion of any investigation, Carelancer may respond in a variety of ways, depending on the severity of the reports and the outcome of the investigation. Carelancer will have sole authority to determine on the appropriate response to a given investigation. Potential responses may include, without limitation,:

· Warnings: Issued for minor infractions, reminding users of their responsibilities under this Policy.

· Temporary Suspension: Temporary restriction of access to the Carelancer platform.

· Permanent Ban: Termination of account access for severe or egregious breaches of this Policy.

Appeals Process

Care Seekers who believe an enforcement action (e.g., warning, suspension) was issued in error may submit an appeal within to Carelancer Support at [email protected]. Appeals will be reviewed in a timely manner, in accordance with Carelancer’s internal processes.

Liability and Role of Carelancer

Carelancer operates as a neutral platform that facilitates connections between Care Seekers and Care Providers. Carelancer does not assume liability for actions, conduct, or events occurring during service engagements.

· Care Seekers and Decision-Makers are responsible for maintaining a safe, professional, and ethical environment for Care Providers.

· Carelancer does not provide insurance coverage for services arranged through the platform. Care Seekers and Care Providers are responsible for their own liability coverage if required.

Care Seekers, Decision-Makers and Care Providers are encouraged to exercise due diligence, professionalism, and mutual respect throughout their interactions.

Policy Updates

This Policy will be reviewed periodically to ensure compliance with changes in legal requirements, industry standards, and platform best practices. Updates to this Policy will be communicated to users via the Carelancer platform and by email.
