Freelancing Eligibility and Usage Policy
Purpose
This policy defines the rules and guidelines for using the Carelancer platform as a Care Provider. It aims to ensure fair usage, protect the platform’s integrity, and support independent freelancers in providing Home Care Assistance Services.

Eligibility
Carelancer is dedicated exclusively to supporting independent freelancers. The following eligibility criteria apply:
1. Individual Use Only: Registration on the platform is permitted solely for individuals (freelancers) providing Home Care Assistance Services.
2. No Agency Representation: Home care agencies, commercial businesses, or similar entities are prohibited from registering as Care Providers or using the platform directly or indirectly.
3. Employee Registrations: Employees of agencies or businesses may only register as Care Providers in their personal capacity. Such registration must not:
o Be connected to their employment.
o Be intended to benefit their employer.
o Involve tasks directed by their employer (e.g., soliciting clients or verifying platform features).

Prohibited Activities
Care Providers are strictly prohibited from engaging in the following activities:
1. Acting on Behalf of an Employer: Using the platform to perform tasks or solicit clients for the benefit of an employer.
2. Soliciting Clients: Engaging in any activities to redirect users (Care Seekers or Decision-Makers) to off-platform services.
3. Unauthorized Commercial Use: Any use of the platform that serves a commercial purpose unrelated to independent freelancing of Assistance Services.

Consequences for Violations
Carelancer enforces a zero-tolerance policy for violations of this policy. Any action contrary to this policy may result, at Carelancer’s sole discretion, in the following:
1. Account Suspension or Termination: Immediate suspension or permanent banning from the platform.
2. Legal Action: In cases of repeated or intentional violations that harm the platform or its users, Carelancer may pursue legal action against:
o The individual Care Provider.
o The employer or agency involved in the violation.

Compliance Responsibility
Care Providers are responsible for ensuring their activities on Carelancer comply with any contractual obligations they have with their employer (e.g., non-compete or moonlighting clauses). Carelancer is not liable for disputes arising from such obligations.

Reporting Violations
Users are encouraged to report any suspected violations of this policy. Reports can be submitted via [email protected] . Carelancer will investigate and take appropriate action based on evidence.

Policy Enforcement and Updates This policy is part of Carelancer’s Terms of Use and is enforceable as such. Carelancer reserves the right to update this policy at any time to reflect operational or legal requirements. Users will be notified of significant changes.
